Terms And Conditions Of AcerStore X U Mobile : Affiliate Marketing Program - From 1/4/2023 To 30/9/2023
This program, named “Worthy Book Merchant Marketing Program” (the “Program”) is organised by Acer Sales & Services Sdn Bhd (“Organiser”). The Program shall run from 1st April 2023 to 30th September 2023 (both dates inclusive) (the “Program Period”).
A. ELIGIBILITY
In order to be eligible to participate in the Program, the Customer must satisfy the following:
· Sign up for a user account in Acer Store at https://store.acer.com/en-my (“Acer Store”).
B. PROMOTION MECHANICS
1. In order to participate in the Program, the Customer must satisfy the following:
· A Maybank Card member (the “Card Member”) shall mean the person to whom the Master Card Credit, VISA Credit, Master Debit, and/or VISA Debit, issued by Malayan Banking Berhad (Co. No. 196001000142 / 3813-K) or Maybank Islamic Berhad (Co. No. 196001000142 / 787435-M) in Malaysia;
· Sign up for a user account (the “Login ID”) in Acer Store;
· Purchase an eligible Acer Model product (see Clause 2 below);
· Enjoy additional discount of five percent (5%) upon checkout.
2. The Card Member must purchase any Acer Model products in Acer Store within the Program Period, EXCEPT the following models / products listed below:

3. Any other new models / products under the Product Series Network Access Storage / Storage (QSAN), Printer (Epson), and Others (Corsair, Creality 3D Printer, Creative Pebble, Jabra, Logitech, NVIDIA, Raspberry Pi, XP-Pen), which are not listed in the above, are also NOT eligible under this Program during the Program Period.
4. Eligible Acer Model products include Gaming models and Non-Gaming models:
· Gaming models refer to any related product under the Nitro or Predator model series;
· Non-Gaming models refer to any product under the Acer, Acerpure, Altos Workstation, Altos Server, Altos Thin Client, Chromebook, Concept D, Projector, and QNAP Storage model series.
C. PROMOTION
1. The Card Member will receive:
a. an additional discount of five percent (5%) in a single receipt (based on the price displayed on Acer Store), subject to Clause 2 below; and/or
b. a free gift (refer to Clause D below).
2. This Program is valid in conjunction with any other ongoing promotions, offers and / or discounts,
EXCEPT for Flash Sale item and/or otherwise stated.
3. This Program is NOT valid for American Express Credit & Charge Card, Worldwide American Express Credit & Charge Card, Master Prepaid, EzyPay (installment), MAE (e-wallet), and M2U (online banking via FPX).
D. FREE GIFT
1. The Card Member is entitled to get only ONE (1) of the following free gifts with purchase of any eligible Acer Model products (Refer to Clause B4) in a single transaction:
· Gaming Model : ONE (1) unit of Predator Cestus 310 Gaming Mouse (worth RM199*)
· Non-Gaming Model : ONE (1) unit of Acer Thin N Light USB Wireless Mouse AMR020
(worth RM99*)
2. The Organiser shall be entitled to, at its sole discretion, decide which gift to be given to the Card Member, if the Card Member purchase both the Gaming Model and Non-Gaming Model in a single transaction during Program Period.
3. All gifts will be given based on a first-come, first-served basis and while stocks last, depending on availability.
4. The Organiser reserved the rights to replace another gift and/or color to the Card Member if the gifts
out of stock without prior notice.
5. The free gift will be delivered together with products purchased.
6. The gifts are non-transferable, non-returnable or not exchangeable for cash, credit, voucher and such
other items in part or in full value.
E. PRIVACY AND DATA PROTECTION
1. The personal data the Customer provides to the Organiser pursuant to this Program, including without limitation the Customer’s name, identification card (IC) number and address, will be processed and are required to administer the Customer’s participation in the Program.
2. In compliance with the laws of Malaysia, the Customer hereby consents and authorises the Organiser to collect, process, to safekeep the required details and to disclose the Customer(s)’ personal details to the related parties involved in organising this Program. Any withdrawal of the Customer(s)’ consent shall be made in writing and received by the Organiser before the expiry of the Program Period. Any withdrawal of the Participant(s)’ consent is given shall be made in writing and received by the Organiser before the expiry of the Program Period and in such event, the Participant(s) shall be deemed to have withdrawn from this Program and may not be entitled to the free gift, subject to the Organiser’s discretion.
3. By providing the personal information upon new user sign up, the Customer consents and agrees to the usage of the Customer’s personal information by the Organiser, including but not limited to names and images, in accordance with the Organiser’s Privacy Policy.
4. In providing the Customer’s telephone, e-mail address, facsimile number or other contact methods the Customer is agreeing that the Organiser and/or its agents and/or its 3rd party service providers may contact the Customer by telephone, email, facsimile or other such methods. Other than those individuals and entities mentioned above, or as informed from time to time, the Customer’s personal data will not be revealed by the Organiser to any other outsiders, unless the Organiser has obtained the Customer’s permission to do so.
5. The Customer shall be responsible for ensuring that such disclosures are in compliance with the provisions of Malaysia’s Personal Data Protection Act 2010.
6. The Customer shall notify the Organiser of any updates, amendments and corrections to previously collected information via the Organiser’s website.
7. Storage and Retention of Personal Data. The Customer’s personal information shall be stored either in hard copies in our offices or in servers located in Malaysia and will be operated and/or used either by us or our service providers. Any Personal Information supplied by the Customer will be retained by our organization as long as necessary or as required to satisfy legal regulatory, accounting requirements or to protect the Organiser’s interests.
8. The Organiser and its parent company may also use the Customer’s personal data to communicate with the Customer about its products and services, update the Customer on new services and benefits, provide personalized Promotion offers and allow the Customer to participate in contests and surveys. In this regard, the Customer’s personal data may be disclosed and transferred to the Organiser’s service providers, suppliers and/or affiliates which may or may not be located outside Malaysia. If the Customer has any complaints, comments or questions on this Privacy Notice, or wish to access or correct the Customer’s personal data, or limit our processing of the same, please contact the Organiser.
F. GENERAL CONDITION
1. Pictures of products shown are for illustration purposes only and may differ from the actual item due to different screen resolution and/or lighting. Price shown may be subject to change from time to time.
2. By participating in this Program, the Customer agrees to be bound by these Terms and Conditions, the decisions of the Organiser, and all terms and conditions imposed by the Organiser.
3. The Organiser reserves the right to use any photographs (including those of Customer), motion pictures, recordings, or any other media records of the Program, for any legitimate purpose including commercial advertising and distribution to sponsors anywhere in the world without any prior notification and/or payment to the Customer.
4. To the maximum extent permitted by law, the Organiser and its parent company, affiliates, related corporations, subsidiaries, directors, officers, employees and agents accept no responsibility whatsoever for any liabilities of any kind for any damage to any property that may occur as a consequence of the Customer’s participation in the Program.
5. To the maximum extent permitted by law, the Customer undertakes to indemnify and keep the Organiser and its parent company, affiliates, related corporations, subsidiaries, directors, officers, employees and agents harmless and indemnified against any loss, damage, claims, costs and expenses which may be incurred or suffered by any or each of them due to the Customer’s breach of any of these Terms and Conditions and/or arising from the Customer’s participation in the Program.
6. The Organiser’s decision is final and binding. In the event of any dispute arising from the Program, or relating to the interpretation of these Terms and Conditions, the decision of the Organiser on all matters pertaining to the Program shall be final and binding on all parties. No correspondence will be entertained.
7. The Customer acknowledges and agrees that no form of cheating will be tolerated. If the Customer is found cheating, as determined in the sole and absolute discretion of the Organiser, the Customer will immediately be disqualified from the Program. Cheating includes, but is not limited to, counterfeiting invoices or receipts, using multiple identification numbers, tampering with, hacking of the Promotion sites (if any), participating in the Program without meeting the eligibility requirements, using any automated software or device to gain an advantage during the Program, use of the Program beyond the defined rules of the Program, attempting to disable or overwhelm any of the Organiser’s websites or the Program sites (if any), attempting to disrupt any portion of the Program, including but not limited to, creating multiple user accounts, using personal information belonging to a third party, allowing someone else to use the Customer’s personal information, or tampering with the redemption process.
8. Any attempt by a person to deliberately damage any of the Organiser’s and its parent company's websites, damage the Organiser’s and its parent company’s reputation via comments on social media or other medium, or undermine the legitimate operation of the Program may be a violation of criminal and civil laws; and should such an attempt be made, the Organiser reserves the right to seek damages from any such person to the fullest extent permitted by law.
9. The Organiser’s failure to enforce any provision of these Terms and Conditions shall not constitute a waiver of that or of any other provision.
10. The Organiser may modify these Terms and Conditions, without notice, and/or withdraw or terminate the Program at any stage without prior notice and any liability towards anyone.
11. All information is correct at the time of publishing. In the event of any inaccuracy or any discrepancy between the print and online versions, the online version shall prevail over the print version.
12. Each of the provisions of these terms and conditions applies to the maximum extent permitted by applicable law. If a court holds any provision of these Terms and Conditions to be illegal, invalid or unenforceable, the rest of these Terms and Conditions will remain in effect and these Terms and Conditions will be amended to give effect to the eliminated provision to the maximum extent possible.
13. The Organiser shall not be liable for any losses and / or damages which may be suffered by the Customer, and/ or any other party resulting from and/ or arising out of or in connection with this Program and/ or the gift / discount given under this Program.
14. The Program shall be governed by and interpreted in accordance with the laws of Malaysia. The Program is void where prohibited or restricted by law and is subject to all applicable laws.
