eAcer India Private Limited is celebrating its 24th anniversary on 09th September 2023. To make this occasion more memorable for you, Acer is coming up with more exciting events as part of its anniversary celebration.

One of such events shall be “THE ACER DAY LUCKY DRAW EVENT” (shortly referred to as the “Contest”). This contest will be conducted starting on 01st August 2023 from 00:00:00 HRS (IST) and ending on 3rd August 2023 till 23:59:59 HRS (IST) (shortly referred to as the "Contest Period"). Anyone who is Indian Citizen, attained 18 years of age and residing currently within the territory of India except to the residents of the state of Tamil Nadu, is eligible to participate in this Contest subject to the condition that the customer must purchase certain eligible products during the Contest Period only from https://store.acer.com/en-in (shortly referred to as the “Portal”)s.

TERMS AND CONDITIONS OF THE CONTEST

1. The participants must have valid and active email ID duly registered in the Portal and have their billing address only within the territory of India except Tamil Nadu.

2. Employees, contractors, dealers and/or distributors of Acer or their family members, or anyone else directly or indirectly connected with the Acer Day offers are not qualified to participate in the Contest.

3. The participants are deemed to have given their consent to Acer for using their personal information by participating in the Contest. It is further agreed by the participants to receive automated e-mails from Acer containing various offers related to its products and/or other commercial promotions which Acer may think will be useful for them.

4. Acer will select the Contest winners via a random computerized lucky draw of entries received by it in accordance with these Terms and Conditions; and final winners will be decided by Acer at its own discretion.

5. Acer will notify the winners via email immediately after declaring the lucky draw results and the eligible prizes/goodies will be dispatched by Acer on or before 14th Aug 2023 to the billing address registered by the Winners in the Portal.

6. Acer will send the prizes/goodies to the winners via e-mail/post or courier depending upon their nature. In case the nature of prizes/goodies is in the form of 100% Cash Back Offer(s), then Acer will refund 100% of price to the winners of Contest when he or she purchases Acer laptop computers. Acer will not refund 100% Cash Back to the winners directly to their bank account whereas it simply reverses the digital payment process chain.

7. The prizes/goodies are non-exchangeable, non-transferable, and irredeemable for cash or other prizes.

8. Acer retains the right to substitute the prizes/goodies with other prizes/goodies of reasonably similar value in the event of original prizes/goodies are unavailable or cannot be provided for any reasons whatsoever.

9. Acer shall use the personal information provided by the participants, as described in its Privacy Policy, a copy of which can be seen here, and in accordance with the provisions of all applicable laws.

10. The participants hereby agree for collection, retention, usage and distribution of their personal information by Acer for processing them including but not limited to contacting them over phone or email etc.

11. Acer accepts no responsibility for any damage, loss, liabilities, injury or disappointment incurred or suffered by the participant as a result of participating in the Contest or accepting the prizes/goodies. 

12. Acer further disclaims liability for causing harm or damage to the participants’ or any other person's laptop computer/desktop computer/tablet computer resulting from downloading any digital prizes/goodies.

13. Acer reserves the right to modify or discontinue, temporarily or permanently, the Contest with or without prior notice due to reasons beyond its reasonable control. The decision of Acer in all such matters shall be deemed to be final and binding on the participants. 

14. Acer shall not be liable for any failure to comply with its obligations where the failure is caused by something beyond its reasonable control. Such circumstances include but not limited to, weather conditions, fire, flood, hurricane, pandemic and epidemics, quarantine restrictions, strike, industrial dispute, war, hostilities, political unrest, riots, civil commotion, inevitable accidents, supervening legislation.

15. All disputes contemplated under or resulting from the Contest shall be subject to the exclusive jurisdiction of Courts situated at Bangalore only.

REGISTRATION PROCESS FOR EXTENDED WARRANTY + ADP AT CONCESSIONAL RATES ALONG WITH THE TERMS AND CONDITIONS

1. Acer hereby offers certain special offers with respect to extended warranty and protection under accidental damage at reduced or concessional prices.2. The participant has to log on to https://store.acer.com/en-in/, select the offered combo and add it to cart before checking out along with the product.
3. The participant shall have to pay the offer price (if any) along with product cost.
4. If the participant is logged in with their existing login credentials, then they do not need to provide billing and/or delivery address as Acer will send all the prizes/goodies as per details updated in the portal.
5. Basis the offer selected by the participant before checking out, the warranty certificate/accidental damage protection certificate will be sent to the registered e-mail of participant within 14 days since the date of invoice.
6. Prizes/Goodies will be dispatched to the registered address within 30  working days from the date of invoice.
7. Prizes/Goodies of other brands are subject to the terms and conditions of the respective brand’s standard warranty policy. Acer shall not be responsible for any third party brand warranty or their product-related performance.
8. Acer Accessories like mouse, headphone, true wireless come with standard six (06) month Brand warranty.
9. Extended warranty coverage for laptop computers means extended ON-SITE WARRANTY which shall commence from date of expiry of the first year of Acer’s Standard Limited Product Warranty applicable for its products.
10. The offers are applicable only on the selected products as decided by Acer and shall be valid only till the availability of products.
11. The offers are valid only on purchase from Portal and not applicable on products purchased from any other E-commerce portal / Store / Retailer.
12. Prizes/Goodies are not guaranteed on every purchase made during the program period and they will be dispatched directly to participant based on purchase verifications and only verified courier service locations. Acer shall not be responsible for non-service locations delivery of its carrier. 
13. Acer shall not be responsible for delivering the prizes/goodies if the addresses and contact details provided by participant during registrations are incomplete.
14. All disputes contemplated under or resulting from the Contest shall be subject to the exclusive jurisdiction of Courts situated at Bangalore only.
15. Acer shall have the complete right to modify, withdraw or change the program without any prior intimation during the promo period. 
16. All prizes/goodies are subject to availability and in case of stock-out situations, then Acer will cancel or change the prizes/goodies as per their availability.
17. These Offers are available only on selected Products as mentioned in the Portal. 
18. Offers are not applicable on any Recertified Products purchased from the Portal or other Acer products purchased from any retail stores.
19. The visuals shown as a part of offers are only indicative and may not be the actual representation of products. 
20. Acer makes every effort to ensure the accuracy of all information but under no circumstances does it take any responsibility for editorial, photographic or typographic errors.
21. To the extent permitted by the law, the participants agree and undertake not to hold Acer or any of its group entities, respective directors, officers, employees, agents, vendors responsible or liable for any action demand, claims, losses, damage cost, charges and any expenses that they might have suffered, sustained or incurred, or claim to suffer, sustain or incur by way of and/or on account of present offer.
22. Acer does not accept any responsibility for misleading or incorrect information provided by a third party regarding this Promotion.
23. The maximum liability of Acer under the offer shall be limited to the cost of 2 years warranty upgrade pack. There will be no refund or liability of Acer due to any Force Majeure event like act of God including but not limited to natural calamity; pandemic; earthquake; tsunami; flood; or any man-made calamity (including war, coup, riots, bandh or strikes).
24. No cash or credit alternatives will be offered as part of the offer.
25. These offers cannot be clubbed or is not valid in conjunction with any other end‐customer offer run by Acer during the same / earlier period.

NO COST EMI OFFER AND ITS TERMS AND CONDITIONS

 1. Under this offer, the participant will get no cost EMI via upfront discounts on product cost for eligible purchases on the Acer Online Store purchased through HDFC, Axis, ICICI, YES and Kotak Mahindra Bank Credit Cards.
2. The Offer will commence at 1st Aug 2023(00:00 Hours) to 3rd Aug 2023(23:59 Hours).
3. The offer will be applicable only to the purchase transactions made through HDFC, Axis, ICICI, YES and Kotak Mahindra Bank Bank Credit Card for 9, 6 and 3 month tenure.
4. Nine (09) Months No Cost EMI is applicable on products priced above INR 40,000/-.
5. Three (03) & six (06) months No Cost EMI is available on product priced above INR 30,000/-.
6. This offer is available on HDFC, Axis, ICICI, YES and Kotak Mahindra  Bank Credit Card holders on select products. These participants will be able to view the offer on their payment page. No other customers will be able to avail this offer. 
7. Acer reserves the right, at any time, without prior notice and without assigning any reason whatsoever, to add/alter/modify/change or vary these terms and conditions or to replace, wholly or in part, this offer by another offer, whether similar to this Offer or not, or to extend or withdraw it altogether.
8. Cardholders are not bound in any way to participate in this Offer. Any participation is voluntary and the Offer is being made purely on a best effort basis.
9. Nothing herein amounts to a commitment by Acer to conduct further, similar or other offers.
10. The discount applicable on opting for this offer is being offered exclusively by Acer and does not amount to EMI/interest waiver extended by the bank.
11. The participant confirms that he/she will need to pay applicable EMI and interest on total value of the order at the time of payment to the bank in accordance with the terms applicable to the debit card. The interest cost charged by the bank over time is being given back upfront at the time of this purchase and netted off in the Invoice amount. 
12. The discretion to allow the payment lies with the bank issuing the credit card. Acer will have no obligation or liability in the event the bank refuses to process the transaction for any reason.
13. The Bank charges annual interest rates according to the reducing monthly balance. In the monthly reducing cycle, the principal is reduced with every EMI and the interest is calculated on the outstanding balance.
14. If the participant fails in timely payment of EMI, there may be additional interests/penalty which may be levied by the bank which may be higher than the discount offered under this scheme.
15. Any returns/cancellation will be as per Acer’s return/cancellation policy. In case of any kind of return/refund in an EMI transaction, interest already billed in a particular transaction will not be refundable under any circumstances.
16. Acer will not charge processing fee for availing EMI option. Bank may however charge processing fee or cancellation charges as per the banks policies. Such charges shall be paid by the participant and will not be refundable even in the event of return/cancellation of the order.
17. The participant may check with the respective bank/issuer on how a cancellation, refund or pre-closure could affect the EMI terms, and what interest charges would be levied on for the same.
18. Acer retains the right to modify or cancel this offer at its sole discretion.
19. For select products there may be a constraint on number of purchase transactions that can be made per credit card. Also, there may be a constraint on the maximum number of products that can be purchased under this offer in a single transaction. 
20. All disputes contemplated under or resulting from the Contest shall be subject to the exclusive jurisdiction of Courts situated at Bangalore only.
